Terms and Conditions of Sale

1. Who we are

Autozilla is a brand of SARAZINA WORLD CARROS E MOTOS, UNIPESSOAL LDA, NIPC 518591190, headquartered at Rua da Igreja, 20, 3840-302 Ouca, Vagos (Aveiro), Portugal. Contact: +351 928 373 916 (phone and WhatsApp).

Purchases in the USA are made under the dealer licence of SALVAGE MOTORS LLC (Arkansas State Police, #M-13632).

2. Scope

These terms apply to the sale to private individuals (consumers) of vehicles advertised on autozilla.pt.

Sales to professionals (resellers and companies with an intra-community VAT number) are subject to conditions negotiated on a case-by-case basis, in writing. The consumer protection regime does not apply to these sales.

3. Prices

• The advertised price corresponds to the imported vehicle, cleared through customs and delivered in Portugal, including VAT.
• The price does not include ISV (Vehicle Tax), IUC (Road Tax), inspection and homologation at IMT (Institute for Mobility and Transport), nor the Portuguese registration, unless the product sheet expressly indicates "with Portuguese registration included".
• The registration service is quoted separately, at the buyer's request.
• The advertised prices may change until the written offer is accepted. The price of the accepted offer remains unchanged.

4. Proposal, reservation and payment

• The sale is finalized upon written acceptance (email or WhatsApp) of the offer sent by Autozilla. The offer specifies the vehicle, price, estimated delivery time, delivery location, and deposit amount.
• With the down payment, the vehicle is reserved and taken off the market.
• The balance is paid before delivery, unless otherwise specified in the proposal.
• Payments are made only by bank transfer to an account in the name of SARAZINA WORLD CARROS E MOTOS, UNIPESSOAL LDA. We never ask for payments to third-party accounts: if in doubt, please confirm by phone.

5. Deadlines and delivery

• Vehicles already in Portugal: delivery or collection in Ouca, by appointment, after full payment.
• Vehicles in the USA: indicative timeframe of 2.5 to 3 months between purchase and delivery in Portugal (purchase, shipping and customs clearance). The estimated timeframe is stated in the proposal.
• Until delivery, Autozilla assumes responsibility for the risk of loss or damage to the vehicle.
• If Autozilla is unable to deliver the vehicle (loss, serious damage in transit, customs refusal) or if delivery is delayed by more than 60 days from the proposed deadline, the buyer may cancel the purchase and receive a full refund of the amounts paid within 14 days.

6. Information and documentation

• Before any commitment, the buyer receives the photographs, the available documents and the type of US title (clean, salvage or rebuilt).
• On delivery: customs declaration (DAV), US certificate of title, invoice and transport documents, and the vehicle history report (Carfax or AutoCheck) when available.
• In older vehicles, the mileage indicated on the odometer cannot be guaranteed (odometer in miles, previous replacements).
• In the US, vehicle inspections are done on request, by an industry professional, and are a paid service.

7. Legal guarantee of conformity

• Vehicles sold to consumers benefit from the legal guarantee of conformity provided for in Decree-Law No. 84/2021.
• Since these are used goods, the warranty period is 18 months from the date of delivery, when expressly agreed upon in the purchase and sale contract; without such agreement, the period is 3 years.
• With the 18-month warranty, any lack of conformity that becomes apparent within the first year after delivery is presumed to have existed on the date of delivery.
• Specific defects communicated in writing before the sale and expressly accepted by the buyer are not covered.
• Normal wear and tear consistent with the age of the vehicle, wear parts, and damage after delivery (improper use, accident, alterations or repairs made by third parties) are also not covered.
• In the event of non-conformity, the consumer is entitled to repair, replacement, price reduction or termination of the contract, in accordance with the law.

8. Right of withdrawal (distance purchases)

• If the purchase is completed remotely (WhatsApp, telephone or email, without the parties being present simultaneously), the consumer may withdraw from the purchase within 14 days of the vehicle's delivery, without stating a reason (Decree-Law No. 24/2014).
• Cancellation must be communicated in writing. The vehicle is returned in the same condition as when it was delivered, with all documents, and the return shipping costs are the responsibility of the consumer.
• The refund will be processed within 14 days of receiving the returned vehicle. The consumer is responsible for any depreciation resulting from use beyond what is necessary to inspect the vehicle.
• Purchases concluded in person, in Ouca, do not carry a right of withdrawal.

9. Portuguese license plate and historic vehicle

• The Portuguese registration is the responsibility of the buyer. Autozilla can handle the entire process, subject to a quote.
• Vehicles over 30 years old can obtain a historic vehicle certificate, which gives an exemption from IUC (the annual road tax). ISV (the one-off vehicle tax paid at registration) is still due.

10. Complaints and dispute resolution

• The buyer can file a complaint in the electronic Complaints Book (www.livroreclamacoes.pt).
• In the event of a consumer dispute, the consumer may resort to an alternative dispute resolution entity: the Automotive Sector Arbitration Centre (CASA), Av. da República, 44, 3.º Esq., 1050-194 Lisbon, www.arbitragemauto.pt; or the National Consumer Information and Arbitration Centre (CNIACC), www.cniacc.pt.
• These terms are governed by Portuguese law. The court of the district of Aveiro shall have jurisdiction over any disputes, without prejudice to consumer protection rules that allow the consumer to resort to the court of their domicile.
